Non-applicant For Applicant : Mr. Krishna Tandon, Advocate. For Non-applicant/State : Ms. Vaishali Mahilong, Dy. Govt. Advocate. Hon'ble Shri Ramesh Sinha, Chief Justice Order On Board 13.05.2026 1. The applicant has preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 59/2026, registered at Police Station – City Kotwali, Raigarh, District – Raigarh (C.G.) for alleged commission of offence punishable under Section 420, 467, 468, 471/34 of the IPC. 2. As per the prosecution story in brief, is that the complainant namely Chabilal Patel lodged first information report (F.I.R) alleging that in the year 2023 during the selection process of GDS (Gramin Dak Sevak) two candidates applied for the aforesaid post namely Sonam Sahu and Narendra Kumar Chandra, the candidates uploaded their requisite RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 documents online in the portal. The Co-accused got selected and during the verification process on 10/10/2023 their 10th grade mark sheet was found to be forged and therefore the offences were registered against the Co-accused. Thereafter on the basis of memorandum statement, present applicant made an accused. Hence, this application. 3. The learned counsel for the applicant has argued that the applicant is completely innocent and further submitted that the co-accused has been granted regular bail by this Court vide order dated 28.04.2026 passed in MCRC No.2436/2026. Hence, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submitted that though the co-accused has been granted regular bail by this Court vide order dated 15.01.2026 passed in MCRC No.9472/2025, but the said co-accused was arrested and was released on regular bail, and the present one is anticipatory bail application, moreover, the applicant is said to have provided the forged mark-sheets/documents to the co-accused. Therefore, the present anticipatory bail application of the applicant is liable to be rejected. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts & circumstances of the case, allegations levelled against the applicant in the FIR, and from the perusal of the records available, it transpires that though the co-accused has been granted regular bail by this Court vide order dated 15.01.2026 passed in MCRC 3 No.9472/2025, but the said co-accused was arrested and was released on regular bail, and the present one is anticipatory bail application, moreover, the applicant is said to have provided the forged mark- sheets/documents to the co-accused, thus, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the Second Anticipatory Bail application of the applicant – Vinod Kumar Rathour, filed under Section 482 of the BNSS, 2023 in connection with Crime No. 59/2026, registered at Police Station – City Kotwali, Raigarh, District – Raigarh (C.G.) for alleged commission of offence punishable under Section 420, 467, 468, 471/34 of the IPC, is rejected.
