GP FOR REVENUE 3 BKM,J W.P.No.7968 of 2026 The Court made the following Order: Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondent Nos. 1 to 5. 2. The issuance of notice to the 6th respondent is dispensed with as no prejudice would cause to him even if it is disposed of in his absence. 3. This writ petition is filed questioning the action of the respondent Nos.3 and 4 in not considering the representations of the petitioner dated 06.03.2026 and 23.12.2025 to grant appropriate compensation for the land acquisition to form the new highway apart from the extent of Ac.2.00 cents in Sy.No.8-5, khata No.39 situated at Seribayalu Revenue Village, Paderu Mandal, Alluri Sitaramaraju District and the 6th respondent is trying to tamper the Revenue records with the support from the official respondents. 4. On the other hand, the learned Assistant Government Pleader relying upon the written instructions of the 4th respondent dated 24.03.2026 submits that the petitioner purchased the land in Sy.No.8/5 in an extent of Ac.2.00 cents of Seribayalu Village from (1) Hanumanthu Uday Kumar S/o (late) Demudu and (2) Hanumanthu Sampath Kumar S/o (late) Demudu, who are the grand sons of the deceased pattadar Hanumanthu Bairagis (first wife’s family members) but the second wife family members are in possession of the subject land. The sale deed dated 29.06.2019 in favour of the petitioner is an un-registered sale document. The writ petitioner is a Government Employee 4 BKM,J W.P.No.7968 of 2026 (working as Teacher in Paderu area). Now the writ petitioner was incorporated in Webland Adangal (Online) in Enjoyer column No.13 without obtaining valid documentation. The writ petitioner is having another un- registered document dated 08.11.2019 executed by the first wife’s daughter- in-law of the deceased pattadar. In the meanwhile, there is a proposal for formation of National Highway No.516E passing through the land in Sy.No.8/5 part, measuring an extent of Ac.0.36 cents of Seribayalu Village of Paderu Mandal. At this point of time the writ petitioner is claiming compensation of the property without valid/registered document in favour of her before the Competent Authority for Land Acquisition (CALA) and the Sub-Collector, Paderu. The said representation was forwarded to the 4th respondent for enquiry and submission of the factual report. As per the revenue records of S.F.A. of Seribayalu Village, Sy.No.8/5 measuring an extent of Ac.2.00 cents was noted in the name of Hanumanthu Bairagi S/o Demullu (deceased pattadar) with Khata No.36 and as per the Webland (online) Adangal, Hanumanthu Demullu S/o (late) Bairagi’s name was incorporated with Khata No.39 for the same extent. As per the local enquiry the second wife’s family member i.e., Hanumanthu Prasad Rao S/o. deceased pattadar Hanumanthu Bairagi is also in possession and enjoyment of the land in an extent of Ac.2.00 cents in Sy.No.8/5 of Seribayalu Village. Hence the claim of compensation was recommended in favour of Hanumanthu Prasad Rao. However, the subject land in Sy.No.8/5 measuring an extent of Ac.2.00 cents in Seribayalu village of Paderu Mandal was not transferred under the Andhra Pradesh 5 BKM,J W.P.No.7968 of 2026 Scheduled Area Land Transfer Regulation, 1959 and the un-registered document could not be considered as a transferred property under Section 5 of the Transfer of Property Act, 1882. Hence the claim of the writ petitioner was rejected. 5. In view of the above said facts and circumstances, recording the said instructions of the 4th respondent dated 24.03.2026, the respondent Nos.3 and 4 are directed to consider and dispose of the representations of the petitioner dated 06.03.2026 and 23.12.2025, if any, strictly in accordance with law, by hearing all the parties concerned, including the petitioner and the 6th respondent and others concerned, giving due opportunity, upon verification of the records and the subject land, appropriate decision shall be taken on its own merits as expeditiously as possible, preferably within a period of four (04) months from the date of receipt of this order. The said instructions of the 4th respondent dated 24.03.2026 shall be made as part of the Court record. 6. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed. __________________________ JUSTICE B. KRISHNA MOHAN 24.03.2026 PGT 6 BKM,J W.P.No.7968 of 2026
