During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have - 3 - HC-KAR NC: 2026:KHC:25895 CRL.P No. 7174 of 2026 filed a joint memorandum of understanding cum compromise deed, which reads as follows: "MEMORANDUM OF UNDERSTANDING CUM COMPROMISE DEED This indenture Memorandum of Understanding Cum Compromise Deed is made and executed on this Twenty Fifth day of February Two Thousand Twenty-Six (25/02/2026) at Bangalore, by and between: 1. Since First Party No. 3 is minor and is represented by her mother First Party No. 1 WHEREAS, the Second Party No. 1 is the faculty working in the New Generation School. The Second Party No. 2 and 3 are father and brother of Second Party No. 1; the Second Party No. 4 & 6 are teaching staff and Second Party No. 5 is non-teaching staff working in the New Generation School. The Second Party No. 7 to 10 are student of New Generation College. - 6 - HC-KAR NC: 2026:KHC:25895 CRL.P No. 7174 of 2026 WHEREAS, due to some misunderstanding, Misrepresenting between First Parties and the Second Parties, about the Disputes and differences arised between the Said Parties. WHEREAS, Consequently, the First Party filed a complaint against the Second Parties, before jurisdictional Basavanagudi Police Station who registered as FIR/Crime No. 17/2026, dated: 14/02/2026, under Section 76, 352, 74, 115 (2), 126(2), 190, 127(2), 189 (2) of Bharatiya Nyaya Sanhita (BNS), 2023 and Section 75 of Juvenile Justice Act, which is pending before the Hon'ble Court of the II Additional Chief Judicial Magistrate at Bangalore (hereinafter "First Complaint"). WHEREAS, Similarly, the Second Party No. 1 filed a counter-complaint against the First Party No. 1 to 3, registered as FIR/Crime No. 18/2026, dated: 17/02/2026 at Basavanagudi Police Station under Section 74, 115(2), 352, 3 (5) of Bharatiya Nyaya Sanhita (BNS), 2023, which is pending before the Hon'ble Court of the II Additional Chief Judicial Magistrate at Bangalore (hereinafter "Counter Complaint"). WHEREAS, the both First Parties and Second Parties have agreed to settle their disputes misunderstanding and differences amicably between themselves without any force, coercion, undue influence etc. from any corner out of their own free and sweet will, with the intervention and presence of the New Generation School Management, elders and well-wishers and also considering that the parties have their whole life ahead of them and pendency of the above mentioned FIR would only pose as a hurdle in leading peaceful life and the stress of pendency of the abovementioned FIR would be constant source of stress for both the parties, the dispute between the First Parties and Second Parties is settled amicably. WHEREAS, the both First Parties and Second Parties have agreed to enter into a transaction as herein above stated and have decided to reduce into writing the terms and conditions of this Memorandum of Understanding - 7 - HC-KAR NC: 2026:KHC:25895 CRL.P No. 7174 of 2026 Cum Compromise Deed just to maintain the peace and harmony: NOW THIS AGREEMENT OF MEMORANDUM OF UNDERSTANDING CUM COMPROMISE DEED WITNESSETH AS FOLLOWS: This Memorandum of Understanding Cum Compromise Deed aims to outline the terms and conditions agreed between the both First Parties and Second Parties as follows: 1. Compromise and Withdrawal of Complaints (a) Both parties agree to unconditionally withdraw their respective complaints (First Complaint and Counter Complaint) filed against each other. (b) The parties shall submit a Memorandum of Understanding Cum Compromise Deed to the Officer- in-Charge of the Basavanagudi Police Station for the closure of both complaints a day of signing this deed. (c) The parties agree to file a joint petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 for quashing the proceedings. (d) That both the parties have agreed that they would jointly approach the Hon'ble High Court of Karnataka by way of quashing petition and both the First Parties and Second Parties would give their respective no objection affidavits/undertakings before the Court and would also appear before the Hon'ble High Court of Karnataka for making necessary statements at the time of hearing of the quashing petition. (e) That it is also agreed between all the parties that after signing the present Memorandum of Understanding Cum Compromise Deed all the parties to the agreement shall not file any civil or criminal proceedings against each other before any court of law/forum/authority. 2. Full and Final Compromise: - 8 - HC-KAR NC: 2026:KHC:25895 CRL.P No. 7174 of 2026 (a) The parties agree that this Compramise is a Full and Final Compromise of all claims, disputes, differences, demands, or grievances, whether known or unknown, arising out of or related to the incidents mentioned above. (b) Neither party shall have any future claims against the other regarding the subject matter of these complaints 3. No Further Action and Peaceful Coexistence: (a) Both parties undertake not to file any fresh criminal or civil complaints against each other or their family members in relation to this dispute in the future. (b) The parties undertake not to interfere in the peaceful life of each other 4. Binding Effect: The terms of this Memorandum of Understanding Cum Compromise Deed are binding upon the parties and their legal heirs, successors, and assigns. 5. That both the parties undertake to abide by the terms elaborated in this Memorandum of Understanding Cum Compromise Deed. That with this Memorandum of Understanding Cum Compromise Deed now there shall remain no more dispute, differences, claim or counter claims among all the parties to the agreement and parties shall take necessary steps and actions to implement this Memorandum of Understanding Cum Compromise Deed in its letter and spirit. 6. That both the parties would remain bound by the clauses of the present Memorandum of Understanding Cum Compromise Deed and the respective statements made by them before the Hon'ble High Court of Karnataka with regards to Compromise of their disputes against each other in all respect. 7. That both the parties shall be bound by the contents of this deed and cooperate with each other in quashing of the FIR in question and shall not move any - 9 - HC-KAR NC: 2026:KHC:25895 CRL.P No. 7174 of 2026 complaint against each other in future regarding the dispute mentioned in the FIR in question. 8. That to avoid future litigation between the First Party and Second Party subsequently this Memorandum of Understanding Cum Compromise Deed is executed. 9. Voluntary Execution: The parties declare that they have executed this Memorandum of Understanding Cum Compromise Deed is executed voluntarily, by both the parties amicably on their own free will and accord without any force, pressure, inducement, coercion, or undue influence and compulsion, or threat whatsoever. 10. That both the parties to this Memorandum of Understanding Cum Compromise Deed are of sound health and mind. They understand all the pros and cons of their acts, conducts, and its connected implications. IN WITNESS WHEREOF, the First Parties and Second Parties have hereunto set and subscribed their signatures and delivered this Memorandum of Understanding Cum Compromise Deed duly executed, in the presence of the Witnesses on the day, month and the year first above written at Bengaluru." 3. In the light of the settlement arrived at between the parties, I deem it appropriate to accept the joint memorandum of understanding cum compromise deed and close the proceedings against the petitioners in the subject petition. 4. The crime so registered against these petitioners in Cr.No.17/2026 stands quashed. 5. For the aforesaid reasons, the following: - 10 - HC-KAR NC: 2026:KHC:25895 CRL.P No. 7174 of 2026 ORDER (i) Criminal Petition is disposed.
