Learned counsel for the petitioner submits that the petitioner is in custody since 18.08.2025 in connection with KarmatanrP.S. Case No. 76 of 2025for the offences registered under Section 64(1) of the B.N.S., 2023, pending in the court of learned Chief Judicial Magistrate, Jamtara. 3. Learned counsel for the petitioner has submitted that the petitioner is in custody since 18.08.2025 and the statement of the victim could not be recorded under Section 183 BNSS as the victim is of unsound mind. 4. The learned counsel for the State has opposed the prayer for bail and has submitted that the victim was found in naked condition and mobile phone and slipper of the accused was also recovered from the place of occurrence. 5. Upon query of this Court, learned counsel for the petitioner has submitted that all the witnesses have been examined and today the date has been fixed for argument. 6. After hearing the learned counsel for the parties and considering the nature of allegation and trial is at the fag end, this Court is not inclined to enlarge the petitioner on bail.
