The petitioners are apprehending their arrest in connection with Ranchi Sadar P.S. Case No.90 of 2026, for the alleged offences registered under Sections 316(2), 318(4), 336(3), 338 and 3(5) of 2026:JHHC:19948 --2-- A.B.A. No. 3649 of 2026 Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned J.M., 1st Class, Ranchi. 3. Learned counsel appearing for the petitioners submits that the present case is counter blast of case being Ranchi Sadar P.S. Case No.71 of 2026 lodged by the petitioner No.1 against the informant namely Zaimun Khatun, Saimun Nisha, Kajal Devi and Istiyak Alam. He further submits that grandfather of petitioner Nos.1 and 2 and great grandfather of petitioner No.3 came in khas and effective possession over the land which was purchased by a registered deeds of sale dated 24.04.1979. He then submits that the allegations are made of getting the land mutated in their name, however, the said was challenged before the Land Reforms Deputy Collector and he has been pleased to set aside the said mutation and directed the parties to move before the learned Civil Court. He next submits that the allegations are civil in nature, however, criminal case has been lodged by the informant, who is the maternal brother of these petitioners. He also submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.29 of the petition. He next submits that the petitioners have complied the notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 and have appeared physically before the Investigating Officer and are ready to cooperate in the investigation. On these grounds, he submits that anticipatory bail may kindly be granted. 2026:JHHC:19948 --3-- A.B.A. No. 3649 of 2026 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of forging the genealogy and obtaining the mutation number and in view of that anticipatory bail may kindly be rejected. 5. Considering that there are case and counter case and the informant is maternal brother of the petitioners and the petitioners have already complied the notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 and they are ready to cooperate in the investigation. Prima facie it appears that there are family dispute and for that criminal case has been lodged. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned J.M., 1st Class, Ranchi in connection with Ranchi Sadar P.S.
