ORAL JUDGMENT (PER: THE HON'BLE MR. JUSTICE M.I.ARUN)
Aggrieved by the
order passed in W.P. No. 101240/2025 c/w W.P. No. 101310/2025 (KLR-LG), the State therein has preferred this appeal. The writ petitions have been disposed with a direction to the State Government as per the undertaking given by the concerned officer with the following observation:
“2. The petitioner in W.P.No.101240/2025 is before this Court seeking for the following reliefs: i. Issue a writ in the nature of mandamus directing the R3 to consider the representation of the petitioner vide Annexure-D and J dated 27.10.2023 and 27.09.2024 and grant land measuring 5 acres and 03 guntas in RS.No.99 of Amate Village of Khanapur Taluk of Belagavi district to the petitioner, considering the report of the R4 bearing No. LND/CR-01/2023-24 dated 27.11.2024 vide Annexure-L, regarding availability of land to

grant in R.S.No.99 of Amate village totally measuring 18 acres, 18 guntas, bounded by towards East: Land in R.S. No.100, towards West: Land in R.S. No.91, Towards North: Land in R.S.no.103 and Towards South: Land in R.S. No.91. ii. Issue any other writ or direction as deem fit by this Hon’ble Court.
3. Despite several directions issued by this Court and the recommendation made, the petitioners having not been granted land, learned Addl. Government Advocate, upon instructions submits that the Assistant Commissioner has written to the Special Land Acquisition Officer, Idkal Dam, to identify and allot appropriate land and that the Special Land Acquisition Officer is in the process of doing the needful, given 60 days’ time grant would be made to the petitioner.
4. Since a positive submission has been made by the learned AGA, placing the said submission on record, hoping that this time the grant would be made within 60 days time, the petition stands disposed.”
2. It is seen that a direction has been issued to the State as per the undertaking given by the State. Hence, the question of entertaining the appeal at the instance of the State does not arise.

3. For the aforementioned reason, the writ appeal stands dismissed.
4. Pending interlocutory applications, if any, stand
disposed of as not surviving for consideration.
