The Hon'ble Court may kindly be please to issue the appropriate Digitally signed by AJINKYA PANSARE Date: 2026.05.11 14:14:30 +0530 2 writ/orders by directing the respondents authorities to immediately pay the salary from 26/4/2021 to 15/12/2021 after adjusting the amount paid to the petitioner. II. The Hon'ble Court may kindly be please to issue the appropriate writ/orders by directing the respondents authorities to pay the interest @ 18% per annum on delay payment and same be recovered from the erring officer who committed delay in making the payment. That further please to direct the respondents to pay the compensation of Rs. 1,00,000/- to the petitioner for mental harassment. III. Any other relief which this Hon'ble Court deems fit and proper under the facts and circumstances of the case and in the interest of justice and cost of the petition may be awarded in favour of the petitioner. 2) Learned counsel for the petitioner submits that petitioner filed this petition claiming arrears of salary and during currency of this petition same have been paid but she is entitled for interest on the delayed payment along with compensation and such amounts have not been paid by the respondent authorities. She further submits that respondent authorities deliberately did not make payment of salary to the petitioner therefore she is entitled for interest as well as compensation on delayed payment. 3) On the other hand, learned State counsel submits that petitioner was a contractual employee who was being paid a fixed honorarium and she was not paid salary for certain period, as she remained absent from her duties. He further submits that subsequently claim of petitioner was adjusted and she has been 3 paid the arrears of salary therefore grievance of petitioner is redressed and this petition may be disposed. 4) Heard. 5) Admittedly, petitioner has claimed arrears of salary along with interest component and compensation as there was delay in payment of salary to the petitioner. However, it appears that petitioner has already been paid the arrears of salary. Therefore, at this stage, this petition stands disposed reserving liberty in favor of petitioner to make a detailed representation before Secretary, Health and Family Welfare Department claiming therein interest and compensation on delayed payment of arrears of salary within period of 30 days from today. It is expected that the authority concerned shall make all endeavors to consider and decide the claim of petitioner expeditiously, preferably within further period of 120 days. 6) With the aforesaid direction, this petition stands disposed.
