1. The application is disposed of with a direction to the petitioner to file certified copy of annexures before the next date of hearing. Crl.M.A. 29839/2026 (Exemption from filing certified copy of annexures)
2. The petitioner / Mr. Raisuddin Malik seeks quashing of FIR No. 392/2021 dated 06.10.2021, filed under Section 135 of the Indian Electricity Act, 1910, at P.S. Darya Ganj, Delhi. The said FIR was registered at the instance of respondent no.2 / BSES Yamuna Power Ltd.

3. The petitioner also seeks quashing of the subsequent proceedings in SC No. 541/2023, titled as ‘State vs. Raisuddin Malik’, pending before the learned Special Judge, Electricity-02, Central. Learned counsel for the petitioner submits that a composite Settlement Agreement has been arrived at with the respondent no.2 / BSES Yamuna Power Ltd in relation to the same. A copy of the said agreement has been placed on record as Annexure P-3 to the present petition.
5. It is conceded by learned counsel for respondent no.2 that the requisite amount has been paid by the petitioner, and that the disputes as regards the claims of the respondent no.2 stands fully settled.
6. The respondent no.2 has no objection to the quashing of the said FIR, and the proceedings arising from it.
7. Considering the circumstances, in terms of dicta laid down by the Supreme Court in Gian Singh v. State of Punjab, (2012) 10 SCC 303 and Narinder Singh v. State of Punjab, (2014) 6 SCC 466, and the fact that an offence under Section 135 of the Indian Electricity Act, 1910 is compoundable, the present petition is allowed.
8. Accordingly, FIR No.392/2021 dated 06.10.2021, and all proceedings emanating therefrom, are quashed.
