By this writ petition, the petitioner has challenged the order dated 12.05.2026 passed in OA No.458/2026 by the Central Administrative 2 Tribunal, Jabalpur Bench at Jabalpur (for short, ‘the Tribunal’). 2. Learned counsel for the petitioner submits that though the Tribunal has directed the petitioner to submit a representation before the concerned Authority, however, till decision on said representation interim protection is not granted and, therefore, this writ petition has been filed by the petitioner. 3. Learned counsel for the respondents/Union of India would submit that the impugned order is passed on the prayer made by the petitioner/applicant before the Tribunal seeking a direction to submit a representation to be decided by the concerned Authority. Accordingly, the order is passed. The petitioner has not made any prayer before the Tribunal for grant of interim relief of stay of the order. 4. At this stage, learned counsel for the petitioner contended that as per his instruction, prayer for direction to submit a representation is made by the Counsel representing the petitioner based on the statement made by counsel for the respondent that the incumbent, who has been transferred in place of the petitioner, has already joined, however, on the said date the said officer/employee has not joined at the place of posting of the petitioner. 5. We have heard learned counsel for the parties and perused the documents available in record of writ petition. 6. On perusal of order dated 12.05.2026, particularly para 3, it is appearing that the order is passed on the prayer made by the Counsel representing the petitioner before the Tribunal. The impugned order 12.05.2026 does not reflect that the Counsel representing the petitioner has made prayer for grant of interim relief and it has been turned down by the Tribunal. 3 7. In the aforementioned facts of the case, we do not find any good ground to admit this petition and to grant the relief as prayed for by the petitioner. 8. Accordingly, the instant writ petition stands dismissed. However, petitioner will be at liberty to file an appropriate application before the Tribunal, if he so desires. CC as per rules.
