The present writ petition has been filed assailing the order dated 06.12.2025, passed by learned Additional Civil Judge and Judicial Magistrate First Class, No. 1, Beawar, whereby the plaintiff-petitioner’s evidence have been closed. 2. Learned counsel for the petitioners submits that he may be granted an opportunity to lead his evidence as the suit is in regard to valuable rights of the petitioners-plaintiffs. He, therefore, prays that he may be granted one last opportunity to lead their evidence. 3. Considered and perused the material available on record as well as the order sheets of the learned Court below. 4. On perusal of the record, it is clear that though the affidavit was filed by the plaintiff-witness Ashok Sahu on 10.02.2025. However, for one reason or the other, he would not have made available for the cross-examination and further since any other [2026:RJ-JP:11173] (4 of 4) [CW-3493/2026] affidavits were not filed by the plaintiff, therefore, the learned Trial Court closed the evidence vide order dated 06.12.2025. 5. Looking to the nature of the suit, this Court deems it appropriate that one last opportunity be granted to the plaintiffs- petitioners to place on record all his evidence by the next date of hearing and the plaintiffs-petitioners shall also ensure all his witnesses are available for cross-examination by the defendant on the same day, subject to payment of cost of Rs.15,000/- to the defendants. 6. Further, the learned Trial Court shall fix the date for cross- examination if due to paucity of time the cross-examination is not completed on the said date, it may fix other dates. 7. If the respondents are in any manner aggrieved by this order then they are free to approach this Court by way of filing a recalling application. 8.
