Contempt Petition under Sections 10 and 12 of the Contempt of Courts Act read with Article 215 of the Constitution of India has been filed on behalf of the Petitioner for initiation of contempt proceedings against the Respondent for wilful and deliberate disobedience of the Orders dated 17.05.2024, 29.01.2025, 21.01.2026, 16.03.2026 and 02.06.2026 passed by the Judicial Magistrate, Mahila Court, South District, Saket, New Delhi (hereinafter ‘JMMC’) in Case No.CR Cases/827/2023 titled ‘State vs. Anoop Khamparia & Ors’. 2. Record shows that from time to time, Orders have been passed by learned JMMC for recovery of Complainant’s istridhan by the Investigating Officer, in which steps are being taken and investigations are ongoing. Copy of the Order dated 03.09.2026 passed by learned JMMC has been filed, which mentions about a Status Report filed by the Investigating Officer, wherein Manappuram Finance Ltd. had stated that the Gold articles, as were initially pledged by the Complainant in her name, has been closed on This is a digitally signed order. It is further noted that a separate Application seeking release of istridhan articles has been filed by the complainant, which is pending consideration. 4. First and foremost, what emerges in this contempt petition is that it pertains to the orders of the learned JMMC which allegedly have not been complied with by the Investigating Officer. The civil contempt is not maintainable. 5. Secondly, it is also moot point, whether the proceedings, which are subject matter of ongoing investigations, is subject-matter for a Contempt Petition. 6. Present Contempt Petition is hereby, disposed of with liberty to the Petitioner to approach the appropriate Forum for its remedies. Pending Applications are also disposed of. NEENA BANSAL KRISHNA, J.
