1. This bail application has been filed by the accused-petitioners under Section 483 of B.N.S.S. in connection with FIR No.256/2025 registered at Police Station Khoh District, Deeg for the offence(s) under Section(s) 319(2), 318(4), 308(2), 317(2), 317(3) 317(4), 317(5), 338, 336(3), 340(2), 61(2)(a), 313 and 303(2) of B.N.S and Section 66D of I.T. Act.
2.
Learned counsel for the petitioners submits that the accused- petitioners have been falsely implicated in this case. Both the petitioners are young boys of 19 years of age and do not have any criminal antecedents. Counsel further submits that the petitioners are in custody since 22.10.2025 and after investigation, charge- sheet has been filed in the matter. Counsel also submits that no
[2026:RJ-JP:5055] (2 of 3) [CRLMB-14481/2025] useful purpose would be served if they are kept in custody, therefore, prays that petitioners may be enlarged on bail. 3. On the contrary, learned Public Prosecutor vehemently opposes the instant bail application and submits that two complaints have been registered against petitioner No.1 and one complaint is registered against petitioner No.2, on the National Cyber Crime Reporting Portal (N.C.R.P.). 4. In respect of complaints registered on N.C.R.P., learned counsel for the petitioners submits that these complaints are also false in nature and total amount involved in these cases is Rs.15,665/-. 5. Having heard the submissions made by learned counsel for the respective parties and taking note of the fact that the charge-sheet has already been filed in this case and the trial is likely to take considerable time, without commenting anything on the merits of the case, this Court deems it just and proper to enlarge the accused-petitioners on bail. 6. Therefore, this bail application is allowed and accused- petitioners Shahbaj s/o Shri Asu and Dhara s/o Shri Fagni is ordered to be released on bail, provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioners shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so. 7. The accused-petitioners Shahbaj s/o Shri Asu and Dhara s/o Shri Fagni are directed to mark their presence on 25th of every
[2026:RJ-JP:5055] (3 of 3) [CRLMB-14481/2025] month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the presence report of the accused-petitioners to the trial Court on the same day of every month. In case of any breach of the above condition, the learned Public Prosecutor shall be free to move an application against the petitioners for cancellation of the bail before the concerned Court. 8.
Office is directed to send a copy of this order to the concerned SHO for necessary compliance. (SANDEEP TANEJA),J AVINASH GULERIA /29
