The present applications have been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’], seeking anticipatory bail for the applicants in connection with FIR No. 40/2026, registered at Police Station Prashant Vihar, Delhi under Sections 420, 406, 468, 120B and 34 of the Indian Penal Code, 1860 [hereinafter This is a digitally signed order. 3. The address of the property, Vehan Shopping Plaza at Ghaziabad, has been verified and found to be correct. As the complainant’s office is situated at Prashant Vihar, the FIR was registered at Police Station Prashant Vihar.

Learned counsel for the applicants submits that they acted as brokers in the sale of the complainant’s shops, for which the complainant received approximately ₹7.5 crore. It is submitted that 14 of the 51 shops have been registered and registration of another 10 is pending before RERA. According to the learned counsel for applicants, the complainant subsequently sought to avoid paying their brokerage and lodged the FIR on false allegations that they had introduced fictitious purchasers and raised false brokerage bills. Learned counsel further submits that the bookings of 36 shops were thereafter cancelled. 5. Per contra, learned counsel for the complainant and the learned APP for the State submit that the applicants failed to join the investigation despite notices being issued to them. They further submit that the applicants received brokerage despite knowing that the purchasers introduced by them were fictitious, and that the bookings were subsequently cancelled. 6. Heard both the parties and perused the material placed on record. 7. It is borne out from the record that sale deeds have been executed in respect of 14 shops, while the purchasers of another 10 shops have approached RERA in relation to their dispute with the complainant. In these circumstances, the dispute, insofar as the applicants are concerned, appears at this stage to arise from the payment of brokerage
8. Accordingly, in the event of their arrest in connection with the aforesaid FIR, each applicant shall be released on anticipatory bail upon furnishing a This is a digitally signed order. bail bond to the sum of Rs. 25,000/- with a surety of the like amount, to the satisfaction of the concerned Station House Officer [SHO] / Investigating Officer [IO], subject to the following conditions: (i) Each applicant shall join the investigation as and when required by the IO and shall furnish his mobile number and permanent residential address to the IO by tomorrow. (ii) Each applicant shall remain available on the mobile number furnished by him to the IO. (iii) Neither applicant shall, directly or indirectly, influence any witness or tamper with the evidence. (iv) Each applicant shall promptly inform the IO of any change in his residential address or contact details.
(v) Neither applicant shall leave India without the prior permission of the learned Trial Court. 9. Accordingly, the present bail applications are allowed in the above terms and therefore, stand disposed of. Pending application[s], if any, also stand[s] disposed of. 10.
