Heard learned counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, ‘the learned Trial Court’ issued a Non-Bailable Warrant (NBW) against the Petitioner/Accused No.2 for his non-appearance on 27.01.2026. The impugned order does not disclose that the Petitioner had, on earlier occasions, failed to appear before ‘the learned Trial Court’. 4, Considering the facts and circumstances of the case, the order passed by ‘the learned Trial Court’ is set aside. The NBW is re-called, subject to the Petitioner/Accused No.2 appearing before ‘the learned Trial Court’ on the next date of adjournment without fail. 3 5.
