JUSTICE H.P.SANDESH ORAL ORDER This Court has issued the non-bailable warrant on 15.04.2026 and subsequently an application I.A.No.2/2026 is filed to recall the non-bailable warrant, the same was rejected. Once again, an application is filed by accused in I.A.No.3/2026 for recalling the non-bailable warrant for which, the office has raised the objection. The revision petitioner has not complied the said objection. 2. Having perused the records, this Court suspended the sentence vide order dated 13.12.2022 and the matter is not yet admitted and revision petitioner's counsel is also not pursuing the matter and counsel for the respondent also made the submission on 17.07.2025 that revision petitioner has not deposited the amount as per the order of this Court and this Court also taken note of - 3 - HC-KAR NC: 2026:KHC:26567 CRL.RP No. 1451 of 2022 that there was no representation. Even there is no any submission with regard to the compliance of the order passed by this Court. Subsequently, on 27.02.2026, an application is filed to comply with the order dated 13.12.2022 and the same is also dismissed in coming to the conclusion that even after a lapse of more than 3 years, the said order is not complied and no reasons are offered by the petitioner and also directed the Registry to forthwith return the trial Court records so as to enable the trial Court to proceed against the petitioner in accordance with law. Subsequently, counsel is also changed and even after change of counsel, the matter is not pursued and in view of revision petition is not admitted the question of consideration of this revision petition does not arise when the conditional order was not complied and accordingly, dismissed.
