NATARAJ ORAL ORDER The petitioner has sought for a writ in the nature of mandamus to direct the respondent Nos.2, 3 and 4 to consider his representation dated 10.03.2026 and pay compensation in respect of the acquisition of 1 acre of land in Sy.No.8/4 situated at Cheelamanahalli Village, Gauribidanur Taluk, Chikkaballapura District. 2. (i) The petitioner contends that his father was the owner of land bearing Sy.No.8/4 of Cheelamanahalli Village, Gauribidanur Taluk, Chikkaballapura District, measuring 1 acre 37 guntas. It appears that the respondents had formed sites in - 3 - HC-KAR NC: 2026:KHC:26385 WP No. 11479 of 2026 1 acre of land, which were distributed amongst the beneficiaries. Thereafter, entries were made in the revenue records for the year 1989-1990, by which it was indicated that a portion of the land was acquired for the formation of sites. The petitioner contends that no acquisition notification was issued and that the respondent Nos.2, 3 and 4 had unlawfully taken over the land belonging to the petitioner and had formed sites. (ii) He therefore submitted a representation dated 10.03.2026 requesting the respondent Nos.2, 3 and 4 to pay compensation in respect of the using up 1 acre of land. The petitioner contends that the said representation is not considered and therefore prays that a direction be issued to the respondent Nos.2, 3 and 4 to consider the representation. 3. The learned Additional Government Advocate however contend that the petitioner had lied low from the year 1989-1990 and has filed a representation on 10.03.2026 claiming compensation. He contends that even before the respondent Nos.2, 3 and 4 could apply their minds to the representation, the petitioner has approached this Court within - 4 - HC-KAR NC: 2026:KHC:26385 WP No. 11479 of 2026 less than a month from the date of filing the representation. He therefore submits that no indulgence be shown to the petitioner. 4. I have considered the submissions of the learned counsel for the petitioner and the learned Additional Government Advocate for the respondents. 5. The petitioner has given his representation on 10.03.2026. Ideally the petitioner must have waited for the respondent Nos.2, 3 and 4 to have acted on the representation. Therefore, though the petitioner has hastily approached this Court yet the doors of this Court cannot be shut on that ground alone. Since the respondent Nos.2, 3 and 4 are under obligation to consider the representation of the petitioner, a direction deserves to be issued to the respondent Nos.2, 3 and 4 to consider the representation of the petitioner and pass appropriate orders. 6. Hence, the following order is passed: ORDER i. The petition is allowed; - 5 - HC-KAR NC: 2026:KHC:26385 WP No. 11479 of 2026 ii. The respondent Nos.2, 3 and 4 are directed to consider the representation of the petitioner dated 10.03.2026 and consider paying compensation in respect of 1 acre of land in Sy.No.8/4 situated at Cheelamanahalli Village, Gauribidanur Taluk, Chikkaballapura District and pass appropriate orders within a period of three months from the date of receipt of a certified copy of this order.
