HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 13749/2025 Imran Khan S/o Aziz Khan, Aged About 32 Years, R/o Behind Dream Lights Cinema Hall, My School Sujangarh, Police Station Sujangarh, District Churu. Presently Resident Of House No. 334, Sanjay Nagar D, Joshi Marg, Jhotwara, Jaipur. (Presently Confined At Central Jail, Jaipur) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Pankaj Gupta For Respondent(s) : Mr. Manvendra Singh Shekhawat, PP Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 07/01/2026 1. The petitioner has filed this bail application under Section 483 of BNSS in FIR No.440/2025 registered at Police Station Jhotwara, District Jaipur (West) for offence under Sections 111(3), 111(4), 111(5), 253(A), 253(B) and 254 of BNS-2023 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that in the present case, no FIR has been lodged against the present petitioner and only on the report initiated by Police Inspector, SHO, Kardhani Police Station Jhothwara, Jaipur based on FIR No. 1060/2024 registered at Kardhani P.S. against accused Jai Singh Pidwa, proceedings have been started against the petitioner on (2 of 3) [CRLMB-13749/2025] false and concocted ground. He urged that no recovery of any kind or cash has been effected from the possession of the petitioner. He further argued that for the purpose of offence under Section 111 BNS, 2023 which deals with Organised Crime, it is necessary that against a person as a member of organised crime syndicate or on behalf of such syndicate, more than one charge-sheet must have been filed before the competent court within the preceding period of 10 years but no such charge-sheet within the preceeding period of 10 years have been filed against the present petitioner. There is no specific allegation/incident about facilitating the commission of organized crime or otherwise harboring any offender. No CCTV footage video was obtained from the locality in which the petitioner was residing which shows the suspicious activities or involvement of the petitioner in the alleged offence. No call details or any transaction or conversation of any kind which supports the prosecution case is produced. The allegation contained in the report submitted by the Police Inspector, SHO, Kardhani Police Station Jhothwara, Jaipur is omnibus in nature. He further argued that the petitioner is an innocent person who is running a business at Jaipur itself. It is argued that petitioner is behind bars since 08.07.2025. Charge- sheet has been filed. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody and the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. (3 of 3) [CRLMB-13749/2025] 5. On consideration of the rival submissions and material available on record and especially in the light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Imran Khan S/o Aziz Khan, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
