The petitioners has filed this writ petition seeking following reliefs:- “A. Issue an appropriate writ, order or direction, more particularly a writ in the nature of mandamus, commanding the respondents to consider the objections of the petitioner strictly adhere to the principle of “ least damage” under Section 10 (d) of the Telegraph Act, and must consider feasible alternative alignments, in the interest of justice. B. Issue an appropriate writ, order or direction directing respondent No. 2 to consider and adjudicate upon the objections submitted by the petitioners by passing a reasoned and speaking order, within a time frame as may be deemed fit by this Hon’ble Court, in accordance with law; C. Please to reject the existing survey and issue an appropriate writ, order or direction directing the respondents to undertake a fresh survey of the petitioners’ land strictly in accordance with law, ensuring due transparency and objectivity and pending such exercise restrain the respondents, their agents or anyone acting on their behalf from entering upon or utilizing the petitioners’ land in any manner whatsoever; D. Pass such other and further order(s) as this Hon’ble Court may deem fit and proper in the facts and circumstances of the present 5 case, in the interest of justice, equity and good conscience. 2. Learned counsel for the petitioners submits that the grievance of the petitioners is of laying down the transmission line in contravention of the earlier plan. Petitioners have submitted a representation before the respondent No. 2 and he has not taken into consideration the grievance raised and have not passed any orders, therefore, this writ petition is filed. 3. Learned counsel for the respective respondents would oppose the submission and would submit that if for any reason, the petitioners are having the grievances against the laying down of the transmission line and erection of the towers, in contravention of the earlier plan, the petitioners could have raised an objection before the District Magistrate, Raipur. However, no such representation/ objection is enclosed along with the writ petition. 4. At this stage, learned counsel for the petitioners would submit that he may be permitted to submit representation/objection before the District Magistrate, Raipur raising all the grounds as raised in this writ petition. 5. In view of the submission made by learned counsel for the respective parties, this writ petition at this stage is disposed of permitting the petitioners to submit representation/objection before the District Magistrate, Raipur and if such a representation is submitted, the concerned authority shall consider and take decision on the representation/objection to be submitted by the petitioners, in accordance with law, expeditiously thereafter. 6 6. With the aforesaid observation and direction, this writ petition stands disposed of. 7. Accordingly, I.A. No.01/2026, which is an application for urgent hearing and I.A.
