1. Petitioner has filed this writ petition seeking following reliefs.
“10.1 The Hon’ble Court may kindly be pleased to direct the respondent authorities to call service records, pertaining to the instant matter. 10.2 the Hon’ble Court may kindly be pleased to set aside the impugned order dated 11.11.2025 (Annexure P-1) passed by respondent No. 4 and also to set aside the PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA
transfer order dated 30.06.2025 (Annexure P- 2) issued by respondent No. 1. 10.3 the Hon’ble Court may kindly be pleased to direct the respondent authorities to allow the petitioner to continue his work at Office of Sub- Division Agriculture Officer-Ramanujganj, District Koriya, where the petitioner is presently posted. 10.4 that, any other relief which this Hon’ble Court may deem fit and proper together with cost of the petition.”

Learned counsel for petitioner submits that petitioner who is holding post of Asst. Director, Agriculture and is posted in the office of Sub-Division Agriculture office, Ramanunjganj, Balrampur is transferred in the office of Sub-Division, Agriculture Office, Sukma on administrative grounds. He contended that though the order of transfer is dated 30.06.2025, however, till date petitioner has not been relieved. Earlier petitioner has filed a writ petition which was disposed of directing petitioner to submit representation before the committee constituted under the transfer policy and further order has been passed of taking no coercive steps against him. Petitioner submitted representation before the committee, however, the committee did not consider the grounds raised by petitioner in objective manner and has dismissed the same without discussing the grounds raised in the representation. He further submits that two children of petitioner are studying in school, one is in class-7th and other is in class-2nd in New Era Public School, Ramanujganj which is an English medium school and if the petitioner has to join at the transferred place of posting, he will suffer adversely affecting studies of his children. He submits that petitioner is still working in the earlier place of posting and no other person is posted in place of petitioner and therefore transfer order be interdicted. 3. Learned State counsel opposes the submission of learned counsel for petitioner and would submit that transfer of petitioner is on administrative exigency and therefore petitioner is having no case for interference of transfer order. 4. When question is posed to learned counsel for petitioner as to the period of posting at the present place, he fairly submits that petitioner is posted since
2017. 5. I have heard learned counsel for the parties. 6. Considering the fact that petitioner is holding post of Assistant Direction, Agriculture Department, which is Class-II post and he has already completed about more than 7 years at the present place of posting, I do not find any good ground to interfere with the order of transfer of petitioner. 7. Accordingly, this writ petition, so far as it relates to challenging the order of transfer dated 30.06.2025, Annexure P-2, is dismissed. 8. However, considering the fact that two children of the petitioner are studying in school in class 7th and in class 2nd and further considering the decision of Hon’ble Supreme Court in case of SK.

Karuppa Thevan and another reported in (1994) Supp (2) SCC 666, and further that petitioner till date has not been relieved from his earlier place of posting and no other incumbent has been posted in place of posting of petitioner, respondents are
