HC-KAR NC: 2026:KHC:25410 WP No. 10271 of 2026 ORAL ORDER Heard Sri. Pawan Kumar who represents Sri.H.Devendrappa learned counsel on record for the petitioner.
2. Having heard at length learned counsel for the petitioner and upon perusing the relevant material that is brought on record, this Court is of the view that the writ petition can effectively be disposed of without issuance of notice to respondent.
3. This writ petition is filed seeking the Court to set aside the order passed by the Court of IV Additional Principal Judge, Family Court, Bangalore on I.A No.III in M.C.No.390/2025 dated 06.02.2026.
4. Respondent/wife filed I.A. No.III seeking the Court to direct the petitioner herein to pay a sum of Rs.60,000/- per month towards interim maintenance of their minor daughter Kumari. Sai Dhiya and litigation expenses of Rs.1,00,000/-. Family Court through the impugned order

directed the petitioner herein to pay respondent a sum of Rs.8,000/- per month towards interim maintenance of the child and litigation expenses of Rs.10,000/-. Aggrieved by the same this writ petition is filed.
5. Learned counsel for the petitioner submits that petitioner earns Rs.1,25,000/- per month and respondent earns Rs.1,59,000/- per month. Thus the income of the respondent is much higher than that of the petitioner. With her earnings respondent can maintain the child well. However, petitioner is willing to give some amount towards the maintenance of the child. Petitioner can pay a sum of Rs.5,000/- only. Therefore, the impugned order may be modified.
6. By the submission that is made by learned counsel for the petitioner himself it is clear that petitioner as well as the respondent are employees and have their own source of income. While the monthly income of the petitioner is Rs.1,25,984/-, respondent earns

HC-KAR NC: 2026:KHC:25410 WP No. 10271 of 2026 Rs.1,59,938/- per month. Admittedly the child born in the year 2023 who is aged around 3 years, at present is being looked after by the respondent. Respondent/wife who is also an employee admittedly has to take the services of any other person to look after the child while she goes for work. That apart respondent has to incur necessary expenditure for the food, extra nourishment, clothing, medical facilities and other needs for the overall growth of the child.
7. Taking into consideration the totality of facts, Family Court directed the petitioner herein to pay the respondent a sum of Rs.8,000/- per month towards interim maintenance of the child. A person who earns around Rs.1,25,000/- can spend a sum of Rs.8,000/- for the maintenance of his child. No material is on record to show that the petitioner has got any other preferential obligations or necessities. Therefore, this Court is of the view that there are no grounds to interfere with the well reasoned order of the Family Court and the findings given.

ORDER i. The writ petition is dismissed. ii. As the writ petition is disposed of without notice to the respondent, Family Court, Bangalore is directed to serve a copy of this
