3.
Learned counsel for the petitioner submits that the petitioner has prima facie case, balance of convenience and the petitioner will face irreparable loss unless the petition, filed with the prayer to pass an order of injunction restraining the defendants from interfering with the possession of the petitioner who is the plaintiff, is
disposed of. It is next submitted by the learned counsel for the petitioner that though it has not been mentioned in this civil miscellaneous but the M.C.A. No. 9 of 2026 is next fixed to
17.07.2026. Hence, it is submitted that the prayer has made in this civil miscellaneous petition be allowed.
4. It is needless to mention that the Civil Judges must make all endeavors to dispose of the applications filed under Order- XXXIX, Rule- 1 and 2 of the Code of Civil Procedure, expeditiously or the very purpose of filing the suit and such petitions shall be frustrated. It is also worthwhile to note that the lukewarm and indifferent attitude of the Civil Judges, in becoming reluctant to expeditiously disposing of injunction petitions is one of the reasons, why people are losing faith in adjudication of the disputes by filing civil suits.
5. Keeping in view the facts of the case, this civil miscellaneous petition is disposed of with the direction to the learned Civil Judge (Jr. Division)-I, Jamshedpur to pass appropriate order in accordance with law; in respect of the petition which has been numbered as M.C.A. No. 9 of 2026 on or before 17.07.2026 if the same has not yet been disposed of.
