HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 29/01/2026
1. Apprehending their arrest in connection with FIR No.160/2025 registered at Police Station Khandar, District Sawai Madhopur, for the offences under Sections 115(2), 126(2) and 3(5) of BNS, the accused-petitioners have preferred this criminal miscellaneous bail application under Section 482 of B.N.S.S.
2.
Learned counsel for the accused-petitioners submit that the accused-petitioners have falsely been implicated under Sections 352, 189(2), 115(2) and 126(2) of BNS. It is contended that on the same date another FIR was lodged by the complainant, alleging murder of the deceased Raghuveer and in the said case, the Police after investigation submitted charge-sheet against the present complainant. It is contended that the independent
[2026:RJ-JP:4184] (2 of 3) [CRLMB-14685/2025] witnesses examined in the cross case clearly stated that altercation took place between the deceased and Rohit and he caused injury to deceased and also to Mohan Lal. It is specifically mentioned in the statement of witnesses Kanahiya Mali and Dharmendra that deceased inflicted injury at the head of Mohan Lal and thereafter, Rohit assaulted the deceased resulting in his death. It is also contended that the present FIR is cross FIR of the same incident and investigation was not conducted by the same Investigating Officer. It is further contended that the petitioners are eye-witnesses to the cross case lodged by the wife of the deceased Raghuveer. It is argued that the accused-petitioners are ready and willing to cooperate with the investigation and custodial interrogation of the accused-petitioners are not required, therefore, their anticipatory bail application may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of anticipatory bail application. 4. Heard and perused the material available on the record. 5. Considering the arguments advanced by learned counsel for the petitioners and the charge-sheet of the cross case, it is pertinent that the petitioners were shown as eye-witnesses and the investigation of the present case is not conducted by the Investigating Officer, who conducted the investigation of the cross case, therefore, without commenting anything on the merits of the case, I deem it just and proper to allow the anticipatory bail application of the accused-petitioners. 6. Accordingly, the anticipatory bail application under Section 482 of B.N.S.S. is allowed and it is ordered that in the event of arrest of the accused-petitioners namely; 1. Prabhulal S/o
