HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 17161/2025 General Manager, Chokhi Dhani Resorts ----Petitioner Versus Shri Bhagirath Gurjar S/o Shri Ram Nath Gurjar ----Respondent For Petitioner(s) : Mr. Manoj Goyal For Respondent(s) : HON'BLE MR. JUSTICE SAMEER JAIN Order 07/01/2026 Learned counsel for the petitioner has submitted that the award dated 13.11.2024 passed by the learned Labour Court is contradictory in nature, as at one hand it has been stated that the departmental inquiry conducted against the respondent was just and fair while on the other hand the learned Labour Court granted a sum of Rs. 1,00,000/- as compensation after considering the fact that a long period of approximately 20 years has been lapsed since the termination of the respondent. Upon bare perusal of the impugned award dated 13.11.2024, it has been observed that the said compensation of Rs. 1,00,000/- has been awarded after analysis of the fact and circumstances of the case and applying the doctrine of proportionality. It has further been observed that the said award has put to challenge by the petitioner after an inordinate delay of approximately one year. Considering the facts and circumstances of the case at hand, this Court is inclined to issue notices to the respondent. (2 of 2) [CW-17161/2025] Howsoever, the stay application filed by the petitioner is dismissed and it is directed that the sum of Rs. 1,00,000/- as awarded shall be deposited by the petitioner in favor of the respondent till the next date of hearing, failing which the present petition shall stand dismissed automatically, without further reference to the Court. List the matter after six weeks. It is made clear that as per the undertaking given by the respondent, the said amount will remain subjudice and the same shall be treated as amount in protest till the adjudication of the present petition.
