Virender Singh, Judge (Oral) After arguing for some time, learned counsel for the petitioner seeks permission to withdraw the present petition, with liberty to withdraw the application, CMA No.678 of 2024, filed, under Order 6 Rule 17 CPC, which has been decided by the learned trial Court on 03.06.2026 and to file fresh application, under Order 6 Rule 17 CPC. Leave and liberty, as sought is granted. The present petition is disposed of as not pressed, with the liberty as aforesaid. 1 Whether Reporters of local papers may be allowed to see the judgment? Yes.

2. In view of the withdrawal of application, under
Order 6 Rule 17 CPC, the order dated 03.06.2026, passed in CMA No. 678 of 2024, is set aside.
3. In case, fresh application, under Order 6 Rule 17 CPC is filed by the defendants, the learned trial Court is requested to decide the said application, in accordance with law, expeditiously, preferably within a period of six weeks from the date of filing thereof, that too, without being influenced by the earlier order dated 03.06.2026. Non applicant Sarvan Singh, will be at liberty to take all the legal objections, as per law. Pending application(s), if any, shall also stand
disposed of.
