The present Petition has been filed under Section 25-B(8) of the Delhi Rent Control Act, 1958 [“DRC Act”], challenging the Judgment dated 06.12.2018 [“Impugned Judgment”] passed by the learned CCJ-cum-ARC, Pilot Court, Central District, Tis Hazari Courts, Delhi [“learned ARC”], in Eviction Petition bearing Case No. E-51/2018 and CIS No. 73/2018, titled “Sh. Raj Kumar Kapoor v. Sh. Dalip Kumar Sharma”. 2. By way of the Impugned Judgment, an eviction order was passed against the Petitioner in respect of one shop situated on the ground floor, forming part of Property No. 1275, Vakilpura, Jama This is a digitally signed order. Learned counsel appearing on behalf of the parties, on instructions, submit that the parties are ad idem that the Petitioner may be permitted to continue in occupation of the Tenanted Premises for a period of one (01) calendar year from today, subject to the Petitioner continuing to pay rent at the rate of Rs.7,000/- per month. The Petitioner also states that he waives his rights under Section 19 of the DRC Act in respect of the Tenanted Premises. 4. The Petitioner, who is also present in person, undertakes to file an Affidavit incorporating the aforesaid undertakings within a period of four (04) weeks from today. 5. It is further agreed between the parties that, in the event the Affidavit of Undertaking is not filed within the stipulated period of four (04) weeks, the Petitioner shall be liable to vacate the Tenanted Premises forthwith. 6. It is also agreed that, in the event of any breach of the aforesaid undertaking, the Respondent shall be at liberty to avail of such remedies as may be available in law, inter alia, by initiating appropriate contempt proceedings against the Petitioner. 7.
