1. This hearing has been done through hybrid mode. 2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’], seeking quashing of FIR No. 314/2020 dated 27.08.2020, registered at Police Station Kanjhawala, Delhi, under Sections 376, 363 and 366 of the Indian Penal Code, 1860 [hereinafter referred to as ‘IPC’] and Section 6 of the Protection of Children from Sexual Offences Act, 2012 [hereinafter referred to as ‘POCSO Act’], and all consequential proceedings emanating therefrom, on the basis of an amicable settlement arrived at between the parties. 3. Issue Notice. Learned APP for the State accepts notice on behalf of the State. This is a digitally signed order. 4. The Petitioner and Respondent No.2 are present before this Court. Respondent No. 2 has been duly identified by the concerned Investigating Officer [IO]. 5. Briefly stated, the aforesaid FIR was registered at the instance of the mother of respondent No. 2 against the petitioner. Upon completion of investigation, a chargesheet was filed on 20.08.2021. As per the petition, the petitioner and respondent No. 2 are married and are presently residing together with their three children. During the pendency of the proceedings, the parties amicably resolved their disputes vide Settlement Agreement dated 08.09.2026, pursuant to which respondent No. 2 has stated that she has no objection to the quashing of the aforesaid FIR and the proceedings arising therefrom. 6. On a query made by this Court, respondent No. 2, who has been duly identified by the IO, has stated that she entered into the Settlement Agreement dated 08.09.2026 of her own free will and without any pressure, coercion, undue influence or threat.
She has further stated that she has no objection if the aforementioned FIR is quashed. 7. In view of the above, since the parties have amicably resolved their differences of their own free will and without any pressure, coercion, undue influence or threat, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end. Accordingly, the aforesaid FIR and all proceedings arising therefrom are liable to be quashed. 8. Therefore, the present petition is allowed and thereby, disposed of. 10. The pending application also stands disposed of. 11.
