[2026:RJ-JP:962] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 13539/2025 Pappuram Jat @ Jamnalal S/o Nagjiram, Aged About 41 Years, R/o Ladupura, Police Station Gangrar, District Chittorgarh ( Rajasthan) ( At Present Confined In Central Jail Ajmer , District Ajmer) ----Petitioner Versus State Of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Ms. Anushree Sharma For Respondent(s) : Mr. Rhishi Raj Singh Rathore, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 09/01/2026 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 158/2025 registered at Police Station Bhinai, District Ajmer for the offences under Section 8/15 of NDPS Act. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that apart from the disclosure statement of the co-accused, no substantive evidence is available on record to indicate the fact that the petitioner has supplied the contraband to the co-accused Jitendra from whom, poppy husk weighing 100 Kg was recovered. There are no criminal antecedents against the petitioner. The petitioner is in custody since long and charge-sheet has already been submitted and trial of the case may take [2026:RJ-JP:962] (2 of 2) [CRLMB-13539/2025] considerable time, therefore, the bail application of the accused- petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that commercial quantity of poppy husk was recovered from the possession of the other co-accused and upon the information of other co-accused, it was revealed that the petitioner supplied the contraband, therefore, considering the impact of Section 37 of NDPS Act, the bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on record. 5. Considering the fact that apart from the disclosure statement of the co-accused stating that petitioner has supplied the said contraband to the main accused, there is no substantive evidence available on record against the petitioner, charge-sheet has already been submitted and trial of the case may take considerable time, considering the above facts, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Pappuram Jat @ Jamnalal S/o Nagjiram, in connection with FIR No. 158/2025 registered at Police Station Bhinai, District Ajmer, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
