The petitioner is apprehending his arrest in connection with Birni P.S. Case No.60/2026, registered for the offence under Sections 74, 76, 351(2), 352, 3(5) of the BNS, pending in the Court of the learned Chief Judicial Magistrate, Giridih. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case. He further submits that only allegation is there of talking on telephone. He then submits that false allegations are made of threatening the informant of putting the video on social media. He next submits that in the supervision report, the charges against the petitioner under Sections 74, 76, 352 of the BNS have been dropped. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioner. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of talking and threatening the informant of making the video viral on social media. On these grounds, the prayer for anticipatory bail may kindly be rejected. ( 2026:JHHC:20243 ) -2- A.B.A. No. 3103 of 2026 5. Considering that the charges under Sections 74, 76, 352 of the BNS have been dropped, which has come in the supervision note at para 27 of the case diary and further, at para 42 of the case diary, it has been stated that the petitioner is having no criminal antecedent and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Giridih in connection with Birni P.S. Case No.60/2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated: 9th July, 2026 Ajay/
