2. By way of the present application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as
“BNSS”), the applicant is seeking grant of regular bail in connection with FIR No. 386/2023 registered at Police Station Roop Nagar for the commission of an offence under Section 420 of the Indian Penal Code, 1860 (hereinafter referred to as “IPC”).

Learned counsel for the petitioner submits that, though the bail granted to the petitioner was cancelled by the Hon’ble Supreme Court, he was given liberty to file a fresh bail application. He further submits that the chargesheet in the present case has already been filed. Charges have already been framed, This is a digitally signed order. and there are around 23 witnesses who are yet to be examined. He submits that the trial is likely to take time. He further submits that the petitioner has already undergone incarceration for around 20 months and, therefore, he be released on bail. 4. Per contra, learned APP for the State submits that the petitioner was granted bail on the undertaking that he would deposit an amount of Rs. 70,00,000/- in 10 instalments, out of which he deposited only one instalment of Rs. 10,00,000/- and subsequently failed to deposit the remaining amount. Therefore, for this reason, the Hon’ble Supreme Court cancelled his bail. 5. Learned APP for the State further submits that the petitioner entered into an Agreement to Sell in respect of a property with the complainant, which he had already mortgaged with HDB Financial Services and also sold to one Mr. Rajesh Gupta. He submits that, though the petitioner lodged a lost report regarding the original documents of his property bearing No. 24/6, Shakti Nagar, Opposite Piao, Shakti Nagar, Delhi-110007, on 17.06.2016, he subsequently obtained a loan against the property by submitting the original documents before HDB Financial Services, to the tune of Rs. 1 crore 40 lakhs. Subsequently, he sold the same property to one Mr. Rajesh Gupta and thereafter entered into an Agreement to Sell with the present complainant and took a sum of Rs. 80,00,000/-. 6. The Court has heard both the parties. 7. The conduct and criminal intention of the petitioner are clear from the inception of his entering into the transaction with the complainant regarding the property which he had already mortgaged and also sold to one Mr. Rajesh Gupta. The allegations are quite serious, and further, the conduct of the petitioner in undertaking to deposit the amount before the learned Trial Court This is a digitally signed order.

and subsequently depositing only one instalment also cannot be ignored by the Court. 8. No ground for grant of bail is made out. Accordingly, the present application is dismissed.
