Learned counsel for the petitioner submits that since the petitioner has deposited the entire due amount by invoking the Amnesty Scheme of the Department, any representation submitted by him be considered in the light of the said deposit and in terms of the directions issued vide judgment dated 11.11.2025 passed by the Division Bench of this Court at the Principal Seat, Jodhpur in D.B. Special Appeal (Writ) No.555/2023, titled as State of Rajasthan and Ors. Vs. Smt. Om Lata Singhal, as well as in the other connected matters and the order dated 02.05.2023 passed by the Joint Secretary (Mines), Jaipur in the case of Indra Kumar Gurjar Vs. Mining Engineer and Ors.

2. Mr. Rahul Lodha, learned AGC, submits that he has no objection if the petitioner’s representation is considered and decided in accordance with law.
3. Taking note of the above, the writ petition is disposed of with liberty to the petitioner to file a representation along with a certified copy of this order within a period of ten days from today before the Principal Secretary (Mines), Jaipur.
4. In the event of any such representation being filed by the petitioner, the respondents are directed to decide the same strictly in accordance with law, after affording an opportunity of hearing to the petitioner and passing a speaking and reasoned order. While doing so, the respondents shall duly consider the fact that the petitioner has deposited the amount by invoking the Amnesty Scheme and shall also take note of the judgment dated 11.11.2025 passed by the Division Bench at the Principal Seat, Jodhpur, in Smt. Om Lata Singhal (supra) as well as the order dated 02.05.2023 passed by the Joint Secretary (Mines), Jaipur. The exercise shall be completed within a period of one month thereafter.
5. With the above directions, the writ petition is disposed of.
6. Pending application(s), if any, stand disposed of.
7. It is clarified that the petitioner would be at liberty to avail appropriate remedies in accordance with law for redressal of his grievances, if they still survive.
8. Needless to say, this order has been passed only in the context of deciding the representation of the petitioner and in no manner be construed as any determination with respect to the merits or demerits of the case.
