JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.3 in Crime No.17/2026 registered by Kodigehalli Police Station, Bengaluru, for offence punishable under Section 8(c), 22(c) of Narcotic Drugs and Psychotropic Substances Act, 1985, is before this Court in this petition under Section 483 of BNSS Act, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.17/2026 was registered by Kodigehalli Police Station, Bengaluru, for the said offences against unknown persons based on the first information dated 15.01.2026 received from one Anil.M.D, police officer attached to Kodigehalli Police Station. In the said case, the petitioner was arrested on 31.01.2026 and subsequently remanded to judicial custody. His bail application filed before the trial Court in Crl. Misc. - 3 - HC-KAR NC: 2026:KHC:26702 CRL.P No. 5002 of 2026 No.1556/2026 was rejected on 09.03.2026. Therefore, petitioner is before this Court. 4. FIR in the present case was registered against unknown persons after receiving credible information that a person was making attempts to sell the contraband article to the public within the jurisdiction of Kodigehalli Police Station. In the raid that was conducted subsequent to the registration of FIR, accused No.1- P.Abhishek, was arrested on 15.01.2026 and from his custody contraband article allegedly MDMA totally weighing 16 grams was recovered and seized under a mahazar. Based on the confession statement of Accused No.1, petitioner was subsequently arrested on 31.01.2026 and remanded to judicial custody. It is not in dispute that there is no recovery of any contraband article from the possession of the petitioner in the present case. It is also not in dispute that the petitioner has no other criminal antecedents. 5. During the course of investigation, the contraband article was forwarded for chemical - 4 - HC-KAR NC: 2026:KHC:26702 CRL.P No. 5002 of 2026 examination and in the FSL report it was found that the seized contraband article had tested positive to the drug known as Methamphetamine. Taking into consideration that the seized contraband article in the present case is of intermediate quantity, the Accused No.1 has been granted regular bail by the trial court in Crl. Misc.No.4508/2026 disposed of on 25.05.2026. Therefore, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following:- ORDER The Criminal petition is allowed. Petitioner/Accused No.3 in Crime No.17/2026 registered by Kodigehalli Police Station, Bengaluru, for offence punishable under Section 8(c), 22(c) of Narcotic Drugs and Psychotropic Substances Act, 1985, is before this Court in this petition under Section 483 of BNSS Act, 2023, subject to the following conditions; - 5 - HC-KAR NC: 2026:KHC:26702 CRL.P No. 5002 of 2026 a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
