2026:JHHC:19702 IN THE HIGH COURT OF JHARKHAND AT RANCHI Criminal Appeal (S.J.) No.978 of 2025 ---- Karma Kachhap, aged about 18 years, S/o Gondro Kachhap, R/o Village Chanho, P.O.+P.S.-Jariyagarh, District-Khunti. …. …. Appellant Versus 1. The State of Jharkhand 2. Herambi Hemrom, w/o Birsa Hemrom, r/o Chiddi, P.O.+P.S.-Jawagarh, District – Khunti. …. …. Respondents ---- CORAM: HON’BLE MR. JUSTICE RAJESH KUMAR ---- For the Appellant : Mr. Lukesh Kumar, Adv. For the State : Mr. Sanjay Kr. Srivastava, A.P.P. For the Respondent No.2 : Mr. Ayush Kumar, Amicus Curiae ---- 12/Dated: 06th July, 2026 1. Heard learned counsel for the appellant and learned counsel for the State. 2. The appellant who is in custody since 18.01.2025 has approached this Court for grant of regular bail claiming himself to be a major, by challenging the impugned order dated 20.06.2025 passed by the Special Judge Pocso, Khunti in Misc. Criminal Application No.263 of 2025 in connection with Jariyagarh P.S. Case No.03 of 2025 corresponding to Children Case No.01 of 2025, registered for the offence under Sections 103 & 238 of the B.N.S. The case is presently pending in the court of the learned District and Additional Sessions Judge-I, Khunti. 3. It appears that no guardian has come forward to show that he is ready and willing to keep his child in proper care and custody. The crime committed is heinous in nature and as it is being tried by the children court. The social investigation report suggests that there is lack of parental care and it appears that no parents is ready to keep this appellant in his proper care and custody. J.J. Act is protective in nature. 4. Considering the social investigation report and the fact that no parents has come forward to give care to the present appellant and as such there is every possibility that he will go into the company of the anti-social element, I am not inclined to enlarge the appellant on bail, at this stage. Accordingly, the present criminal appeal stands rejected. (Rajesh Kumar, J.) Dated: 06 July, 2026 Amar/- Uploaded on 09.07.2026
