Learned counsel for the petitioner has preferred the present petition questioning the show cause notices dated 24.04.2026 (Nos. 5105 and 5123) and 27.04.2026 (No. 5125), Annexure P/1, issued by respondent No. 5, the Assistant Civil Surgeon- cum-Chief Hospital Superintendent, District Hospital, Jashpur, whereby respondent No. 5 has sought certain documents relating to an alleged incident dated 06.03.2026 at the Blood Centre, District Hospital, Jashpur.

Learned counsel for the petitioner submits that the show cause notices and the documents sought by the respondent
3 are, in fact, a premeditated act and the same are without jurisdiction, as respondent No. 5 was not competent to issue such orders or communications to the petitioner.

Learned counsel for the respondent/State submits that the impugned show cause notices and communications merely seek an explanation from the petitioner, and the petitioner has already submitted his explanation vide Annexure P/9 before the Civil Surgeon/Chief Hospital Superintendent, District Hospital, Jashpur, on 27.04.2026. Learned counsel further submits that respondent No. 5 is competent to seek any explanation or documents from the petitioner and that no departmental enquiry has yet been initiated against the petitioner.
4. I have heard learned counsel for the parties and perused the communications which are under challenge in the present writ petition.
5. From a perusal of the documents annexed as Annexure P/1, it appears that vide communications dated 24.04.2026 and 27.04.2026, the Civil Surgeon as well as the Assistant Civil Surgeon sought certain documents and explanations from the petitioner regarding the alleged incident dated 06.03.2026 at
4 the Blood Centre, District Hospital, Jashpur. The petitioner has already submitted his explanation in response thereto. The case of the petitioner is that he is not responsible for the alleged incident and has been implicated therein despite neither being involved in nor responsible for the said act. Be that as it may, since the petitioner has already submitted his explanation to the impugned notices/communications issued by respondent No. 5, the writ petition is disposed of with a direction to the respondents that, before proceeding against the petitioner, the competent authority/respondents shall consider the explanation submitted by the petitioner in accordance with law, before taking action against him.
6. The writ petition is disposed of with the aforesaid direction. Sd/-
