Criminal Petition was filed under Section 482 of the Code of Criminal Procedure (for brevity, ‘Cr.P.C.’), seeking to quash the proceedings in C.C.No.25 of 2024 on the file of Judicial First Class Magistrate, Paderu, in connection with Cr.No.25 of 2024, for the alleged offences punishable under Sections 353, 341 of Indian Penal Code, 1860 (for brevity, ‘I.P.C’). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. 3. Learned counsel for the petitioner submits that the petitioner has not committed any offence and that he was falsely implicated in this case by respondent No.2 and the inspector of police by abusing their position. 4.
On the other hand, the learned Assistant Public Prosecutor vehemently opposed to grant relief to the petitioner on the ground that the case is well founded and that specific allegations have been levelled against the petitioner, and those allegations are matter for trial to be decided by adducing evidence. 5. On perusal of the record, based on the complaint lodged by respondent No.2, a case in Cr.No.25 of 2024 was registered for the alleged offences punishable under sections 353, 341 of IPC by Station House Officer, Pedabayalu Police Station. After a thorough investigation by examining LWs.1 to 8, the investigation was concluded and a charge sheet was filed. All the list of prosecution witnesses have supported the version of LW.1 and the other eye witnesses. The matter is required to be tried, and the evidence is required to be let in to know the truth or otherwise of the allegations. Therefore, there are no merits in this criminal petition. However, the learned counsel for the
petitioner submits that the petitioner is an Assistant Executive Officer in the office of the Assistant Commissioner (ST), Visakhapatnam and further requests to dispose of the criminal petition by granting the relief of dispensing with the presence of petitioner before the learned trial court. 6 Considering the facts and circumstances of the case, the criminal petition is disposed of, and the presence of the petitioner is dispensed with. The learned Trial Court in C.C.No.134 of 2024 is directed to dispose of the matter in accordance with law. 7. In the result, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _________________________ DR. Y. LAKSHMANA RAO, J Date: 04.02.2026 SAK
