W.P(MD)No. 6310 of 2026 BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED :10.03.2026 CORAM: THE HONOURABLE MR.JUSTICE N.SATHISH KUMAR AND THE HONOURABLE MR.JUSTICE M.JOTHIRAMAN W.P(MD)No. 6310 of 2026 A.Karuppiah ... Petitioner Vs 1. The District Collector, Virudhunagar District. 2. The Revenue Divisional Officer, Aruppukottai, Virudhunagar District. 3. The Tahsildar, Thiruchuli Taluk, Virudhunagar District. 4. A.Pandikannan ... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 3 to remove the illegal encroachment of public land classified as Grama Natham in the village revenue records, encroached by the fourth respondent in Sy. No. 204/34, Pulvaikarai Village, Thiruchuli taluk, Virudhunagar District based on the proceedings of the first respondent dated 09.01.2026 as well as the proceedings of the 1/4 https://www.mhc.tn.gov.in/judis W.P(MD)No. 6310 of 2026 Additional Personal Assistant (Land) to the first respondent and the representation made by the petitioner dated 26.12.2025 respectively within a reasonable time. For Petitioner : Mr.K.C. Ramalingam For R1 to R3 : Mr. S.P.Maharajan Special Government Pleader ORDER (Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner seeks a direction to remove the fourth respondent, who is said to have encroached upon the grama natham land. 2. The details of the affidavit itself indicate that the fourth respondent has encroached upon the grama natham land in survey No. 204/34. Once the land is classified as grama natham, this Court is of the view that the same will not come under the Tamil Nadu Land Encroachment Act, 1905 to take action. Further, the entire prediction is bereft of details as the fourth respondent has encroached upon the grama natham land. In such view of the matter, we cannot give a positive direction in this regard. Hence, we find no merits in the writ petition. 2/4 https://www.mhc.tn.gov.in/judis W.P(MD)No. 6310 of 2026 3. With the said observations, this Writ Petition is dismissed. No costs.
