And/Or 2026:JHHC:19788 2 b) For the issuance of an appropriate writ/writs, order/orders, direction/directions or writ in nature of certiorari for quashing of the order dated 24.10.2016 passed by the Learned Labour Commissioner cum Appellate Authority under the Payment of Gratuity Act, 1972, Ranchi whereby and where under the petitioner appeal preferred by the petitioner has been dismissed without considering the merits of the case and the petitioner has been directed to pay a sum to the tune of Rs.37,788/- along with interest @8% per annum for the period starting from 02.07.2001 to 31.05.2006 by a non-speaking order. And/or c) To hold and declare that the petitioner is not liable to pay any amount to the respondent employee as the respondent employee was not in continuous service for a period of five years which is a pre-requisite for payment of gratuity. And/or d) During the pendency of the writ application operation of order dated 24.10.2016 and further proceedings thereof may be kept at abeyance. And/or e) Pass such other order/orders as Your Lordships may deem fit and proper in the fact and circumstances of the case doing conscionable justice to the petitioner. 2.
