JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused no.1 in S.C.No.115/2026 pending before the Court of LXIX Addl. City Civil & Sessions Judge, Bengaluru, arising out of Crime No.197/2025 registered by Rajagopal Nagar Police Station, Bengaluru City, for the offences punishable under Sections 118(1), 109 read with 3(5) of BNS, 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the petitioner and the learned Addl. SPP on behalf of the respondent-State. 3. FIR in Crime No.197/2025 was registered by Rajagopal Nagar Police Station, Bengaluru City, initially for the offences punishable under Sections 118(1) read with 3(5) of BNS, 2023, against the petitioner and others based on the first information dated 31.05.2025 received from Sanjay S/o Srinivasa who is the injured victim in the present case. 4. During the course of investigation, petitioner who is arrayed as accused no.1 in the FIR, was arrested on - 3 - HC-KAR NC: 2026:KHC:26908 CRL.P No. 5563 of 2026 01.06.2025 and remanded to judicial custody. After completing investigation, charge sheet is filed against three persons. Petitioner is arrayed as accused no.1 in the charge sheet. His bail application filed in Crl. Misc. No.9298/2025 before the jurisdictional Sessions Court was rejected on 04.11.2025. Therefore, petitioner is before this Court. 5. Perusal of the material on record would go to show that petitioner and the injured victim are friends. On 31.05.2025, petitioner allegedly had summoned Sanjay who is the victim in the present case near his house with an assurance that he would return the amount of Rs.5,000/- which he had borrowed from him. After Sanjay came near the house of the petitioner, he allegedly quarreled with him and thereafter, summoned accused nos.2 & 3 to the spot of incident. 6. In the charge sheet, it is alleged that after quarrelling with the victim in the present case, accused no.1 allegedly held him and accused no.2 assaulted him with a machete on his left hand, and thereafter, accused no.3 also assaulted the victim with the same machete on his head. It is further alleged that subsequently accused no.1 also assaulted the victim with the - 4 - HC-KAR NC: 2026:KHC:26908 CRL.P No. 5563 of 2026 same machete. From the aforesaid, it is apparent that the allegation of assaulting the victim on his hand is only as against accused no.2. 7. The wound certificate of the victim would go to show that he has suffered grievous injuries and the injury found in his hand is certified as grievous injury. Accused no.3 who allegedly had assaulted on the head of the victim with the machete has been granted regular bail by the Trial Court in S.C.No.115/2026 by order dated 24.02.2026. Undisputedly, petitioner has no other criminal antecedents. Petitioner is aged about 22 years and is in custody for the last more than one year. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 8. The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.115/2026 pending before the Court of LXIX Addl. City Civil & Sessions Judge, Bengaluru, arising out of Crime No.197/2025 registered by Rajagopal Nagar Police Station, Bengaluru City, for the offences punishable under - 5 - HC-KAR NC: 2026:KHC:26908 CRL.P No. 5563 of 2026 Sections 118(1), 109 read with 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
