This is second bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita 2023 for grant of regular bail to applicant, who has been arrested in connection with Crime No.42/2024, registered at PS – Chando, District – Balrampur-Ramanujganj (C.G.) for commission of offence punishable under Sections 137, 87, 142, 64, 65(1) of Bharatiya Nyaya Sanhita, 2023 and Section 4 & 6 of Protection of Children from Sexual Offences Act (POCSO) Act, 2012. 2. The first bail application filed by the applicant in MCRC No.8938/2024 has already been rejected vide order dated 21.01.2025 by the Co-ordinate Bench of this Court. 3. The allegation against the present applicant as per the prosecution case is that, the present applicant knowing the fact that the prosecutrix was a PRAKASH KUMAR Digitally signed by PRAKASH KUMAR Date: 2026.05.12 16:50:56 +0530
2 minor, he is said to have taken the prosecutrix to his house and there he on the pretext of marriage had committed a physical relationship with her and he is already a married man. Subsequently, an F.I.R. in this regard was lodged and the present applicant has been arrested on 12.09.2024. 4. Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He further submits that the statement of the victim has been examined and statement of other witnesses are yet to be examined. He further submits that applicant is in jail since 12.09.2024, charge-sheet has already been filed and conclusion of trial may take some time, hence, applicant may be released on bail. 5. Per contra, learned counsel for the State opposes the bail application.
He further submits that the first bail application of the applicant has already been dismissed on merit on 21.01.2025 in MCRC No.8938/2024, and that the statement of the prosecutrix has been examined wherein she has supported the case of the prosecution. 6. Heard learned counsel for the parties and perused the case diary. 7. Considering the facts and circumstances of the case, and further considering that there is no substantial change in circumstances, I am not inclined to grant bail to the applicant. 8.
