1. This writ petition is filed on behalf of Petitioner under Article 226 of the Constitution of India seeking a direction to Respondent No. 2/Registrar of Trade Marks to process and allow Form TM-12 filed by the Petitioner on 21.02.2012 in respect of Trademark Registration No. 1081552 as also to direct that the demand of Rs. 5,000/- towards surcharge be waived.

law on a renewal request being filed by the Petitioner in a time bound manner and subject to payment of prescribed fee and restoration charges as also surcharge of Rs.5,000/-.
3. In light of the stand taken by Respondent No. 2, this writ petition is
disposed of, granting liberty to the Petitioner to file the appropriate application for renewal of registration of the trademark along with the prescribed fee, restoration charges and surcharge of Rs.5,000/- within a maximum period of one month from today. On the application being filed and formalities being completed, Respondent No. 2 shall process the application in accordance with law. Needless to state that if the trademark registration is renewed, it will be open to the Petitioner to take further steps for renewal of the mark for the next ten years.
4. Writ petition stands disposed of in the aforesaid terms, with no expression on the merits of the case.
