297-FA-1557-16 (+1).odt 1 IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD 297 FIRST APPEAL NO. 1557 OF 2016 The State Of Maharashtra VERSUS Dilip Vishwanath Patil …… Mr. B.A. Shinde, AGP for Appellant-State …… 298 FIRST APPEAL NO. 1558 OF 2016 The State Of Maharashtra VERSUS Sharat Vishwanath Patil …… Mr. S.N. Morampalle, AGP for Appellant-State …… CORAM : SIDDHESHWAR S. THOMBRE, J. DATE : 06 OCTOBER, 2026 PER COURT :
1. Heard learned AGPs for the Appellant-State
2. By these Appeals, the appellant-State takes exception to the common impugned Judgment and Award dated 16.11.2006 passed by the learned Joint Civil Judge, Senior Division, Jalgaon, in Land Acquisition Reference Nos 147 of 2006 and 146 of 2006, whereby the learned Reference Court has enhanced the compensation payable to the claimant. The Special Land Acquisition Officer had determined the compensation at the rate of Rs.1,25,000/- per hectare for dry lands. 2026:BHC-AUG:47253
297-FA-1557-16 (+1).odt 2
3. The issue involved in the present Appeal is no longer res integra. A Division Bench of this Court, in Special Land Acquisition Officer (III), Jalgaon and another Vs. Bhagwat Vitthal Sonwane, reported in 2009 (4) Mh.L.J. 308, has already considered the market value of the lands acquired for the same project and determined the appropriate rates of compensation. The said decision, therefore, squarely covers the controversy involved in the present Appeal.
4. In view of the aforesaid binding decision of the Division Bench, no useful purpose would be served by examining the quantum of compensation independently in the present Appeal. In the circumstances, I am not inclined to entertain the present Appeal. The Appeal is, therefore, liable to be dismissed.
5. The First Appeals are dismissed.
