04/ 25.03.2026: Heard learned counsel for the petitioners and learned counsel for the respondent-JSSC.
2. The prayer of the petitioners is for appointment on the post of Assistant Teacher in Class VI to VIII. It is the case that in spite of having qualifying
marks, the petitioners have not been appointed.
3. During course of argument today, the marks of all the petitioners have been disclosed. The petitioner No.1 has obtained 194.34, petitioner No.2 has obtained 162.59, petitioner No.3 has obtained 192.34, petitioner No.4 has obtained 195.43, petitioner No.5 has obtained 128.499 and petitioner No.6 has obtained 195.380 marks. The petitioner Nos.1, 3, 4 and 6 are in Scheduled Tribes category and petitioner Nos.2 and 5 are in Scheduled Castes category.
4. Admittedly, the last selected candidate has obtained 204.18292126 in Scheduled Tribes category and the last selected candidate in Scheduled Castes Category is 151.17239955. Thus, the petitioner No.2, namely, Ajay Kumar Das has qualified and it has been submitted by the learned counsel for the respondent- JSSC that appropriate steps should be taken for recommendation of the name of respondent No.2.
5. So far as other petitioners are concerned, since the last selected candidate has obtained much more marks than the petitioners they could not be considered now.
6. So far as the rest of the petitioners are concerned, since the process of appointment is continuing, if any candidates in the category and subject of the petitioners, obtained lesser marks is recommended for appointment, the petitioners will approach the respondent-JSSC for appropriate relief. In that event, the respondent-JSSC will pass an appropriate order.
7. With the aforesaid observations and directions, this writ petition is
disposed of.
