The petitioner is apprehending his arrest in connection with Sisai P.S. Case No.124/2025, registered for the offence under Sections 303(2), 317(5), 3(5) of the BNS, 2023, Section 4/21 of MMDR Act, 1957, Rule 4/54 of JMMC Rules, Rule 7/9 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in the Court of the learned Sub Divisional Judicial Magistrate, Gumla. 3. Learned counsel appearing for the petitioner submits that the petitioner happened to be owner of Hywa. She further submits that the allegations are made of carrying 550 cft. sand. She then submits that the driver of the said Hywa has been granted anticipatory bail by this Court in A.B.A. No.3217 of 2026. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of illegally carrying 550 cft. sand on the said Hywa and in view of that, the prayer for anticipatory bail may kindly be rejected. Considering that the petitioner is the owner of Hywa and driver of the Hywa has been granted anticipatory bail by this Court in the aforesaid A.B.A. and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Gumla in connection with Sisai P.S.
