The present petition under Article 226 and 227 of the Constitution of India, 1950, seeks the following prayers: “i. Pass necessary orders and directions thereby calling for the records of Case No. 1317 titled "The Management Of Deepak Memorial Hospital & Medical Research Center versus Sh.R.N.Giri" decided vide impugned order /award dated 05.09.2008 passed by the Assistant Labour Commissioner East, Jhilmil Colony, Shahdara, Delhi-95. ii. Pass necessary Writ, orders and directions thereby quashing, canceling and setting aside the impugned order / award dated 05.09.2008 passed by the Assistant Labour Commissioner East, This is a digitally signed order. Pass any other order or direction as this Hon'ble court may deem fit and proper in the facts and circumstances of the case.” 3. Learned counsel for the petitioner submits that during the pendency of the present petition, subsequent orders have been passed on the complaint filed on behalf of the respondents in CC No. 4929/2016 (Old No. 126/2010), which was disposed of by learned Presiding Officer, Industrial Tribunal, Dwarka Courts, New Delhi vide award dated 29.09.2018, by holding that the complainant/workman was not interested to pursue the said complaint and thus, was not entitled to any relief in the same. It is pointed out subsequently, two applications were filed on behalf of the respondent/workman for restitution of the said complaint, the same were again dismissed vide orders dated 09.11.2020 and 10.08.2023. The copies of the said orders are handed up in Court today and are taken on record. He submits, in view of the same, he seeks leave to withdraw the present petition. 4. Accordingly, the present petition is dismissed as withdrawn and disposed of. 5. Pending application(s), if any, also stands disposed of.
