The petitioners have filed this bail application under Section 483 of BNSS in FIR No.215/2025 registered at Police Station Baswa, District Dausa for offences under Sections 191(2), 191(3), 190, 115(2), 126(2), 109(1), 352, 351(2), 103(1), 125(a) of BNS, 2023 and Sections 3, 25, 5 and 27 of Arms Act, 1959.
[2026:RJ-JP:1879] (2 of 3) [CRLMB-14178/2025]
2. Heard learned counsel for the petitioners, learned Public Prosecutor as well as learned counsel for the complainant and perused the material available on record.
3.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the allegations levelled against the petitioners are limited to stone-pelting at the victims. The petitioners are women with no criminal antecedents. No specific overt act has been attributed to them. The allegation of causing the death of Kailashi Devi is specifically attributed to Rajendra, while the injury dangerous to life sustained by injured Gopal is attributed to co-accused Ramji Lal. The allegations against the petitioners are general and omnibus in nature. Petitioners are behind the bars since
26.09.2025. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence, the bail application of the petitioners may be allowed.
4. Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail application.
5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.
6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Smt. Bhagwati Devi W/o Shri Ghanshyam, Smt. Guddi Devi W/o Shri Ramjilal and Smt. Rajanti Devi W/o Shri Radheyshyam,
[2026:RJ-JP:1879] (3 of 3) [CRLMB-14178/2025] shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before the Court on all the dates till conclusion of the trial.
