p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK
ABLAPL No.5135 of 2026
Dr. Randall Sequeira …. Petitioner
Mr. P.K.Jena, Advocate
-Versus-
State of Odisha …. Opposite Party
Mr. S.K. Lenka, ASC
CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 12.05.2026
01.
1. Heard learned counsel for the petitioner and State.
2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Kashipur P.S. Case No.87 of 2026 corresponding to G.R. Case No.204 of 2026 pending in the file of learned J.M.F.C., Kashipur on the grounds stated.
3. Perused the FIR as at Annexure-1. Recorded the
submissions of learned counsel for the respective parties. On a reading of the FIR, it is made to understand that there was protest by the locals at the time when the police party was to execute a warrant of arrest against one Subash Singh Majhi. It is submitted that since the protest was allegedly led by the petitioner, so he apprehends arrest in the hands of the local PS. The further submission is that such claim is also misconceived as the petitioner was not even present at the spot when the police team arrived. It is claimed that the petitioner is a doctor p. 2 of Medicine and he frequently visits the remote areas to treat the tribals and may be having sympathy for them and therefore, he has been named in the FIR but he has no other antecedent and therefore, considering the same, the Court should allow him to go on bail with any conditions. Recorded the objection of Mr. Lenka, learned ASC for the State. It is informed to the Court that there has been no any damage to public property during and in course of the protest by the locals nor any of the police officials received serious injury. The Court finds that the local villagers around 100 in number opposed arrest of said Subash Singh Majhi against whom a warrant of arrest was pending execution being involved in other criminal cases without anything really mentioned in the FIR about the kind of mischief committed by the petitioner. Considering the above
facts and the circumstances under which the alleged incident took place, the claim that the search was in respect of a local leader opposing mining activities by the Government, this Court, recording the objection of the State, though not in favour of entertaining his bail plea, however, allows the liberty for him to surrender before the learned court below for being released with suitable conditions imposed.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned J.M.F.C., Kashipur in connection with G.R. Case No.204 of 2026 corresponding to Kashipur P.S. Case No.87 of 2026 within a p. 3 fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.10,000/- (rupees ten thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper in the facts and circumstances of the case.
6. Issue urgent certified copy of this order as per rules.
