The present Application has been filed on behalf of the Plaintiff under Order XXIII Rule 1 read with Section 151 of CPC seeking withdrawal of the present Suit in view of the Settlement Deed dated 23.01.2026 (hereinafter referred to as “Settlement Deed”) entered into between the parties during the pendency of the present Suit. 2. The present Suit is one for damages and permanent and mandatory injunction against Defendant Nos. 1 & 2. 3. It is stated that during the pendency of the present Suit, the Parties have entered into a settlement vide the said Settlement Deed. The Settlement Agreement has been signed by all the Parties. This Court has gone through the Settlement Agreement, the terms of which are legal and lawful. 5. In view of the fact that the Settlement Deed has been entered into between the parties, permission is granted to the Plaintiff to withdraw the present Suit. 6. Accordingly, the Suit is disposed of as withdrawn. Pending applications, if any, also stand disposed of. 7. Since the Parties have entered into the Settlement Agreement, the Plaintiff is entitled to a refund of court fees in terms of Section 16 of the Court Fees Act, 1870.
