Mr. Saurav Adhikari, learned counsel appearing for Indian Railways submits that writ petition would not be maintainable, as petitioner has remedy of departmental appeal, and after departmental appeal, he can approach Central Administrative Tribunal. 4. Learned counsel for the petitioner submits that punishment order was passed without affording any opportunity of hearing to the petitioner. He submits that departmental appeal has become time barred, as the period of limitation has expired. 5. Having regard to the facts of the case, the writ petition is disposed of with liberty to petitioner to file appeal before the competent authority. If he files appeal by 10.04.2026, the same shall be heard and decided on merits.
