1. The present petition has been filed seeking quashing of the FIR bearing No. 316/2016 dated 10th July, 2016 registered at Police Station Sunlight Colony under Sections 498A/406/506/509/34 of the Indian Penal Code, 1860 and the proceedings arising therefrom, on the basis of settlement. 2. The settlement arrived at between the parties is recorded in the order passed by the Division Bench of this Court on 28th October, 2024 in MAT.APP.(F.C.) 58/2023 and MAT.APP.(F.C.) 142/2023. In terms of the aforesaid settlement, a sum of Rs. 9,00,000/- was payable by petitioner no.1 This is a digitally signed order. CRL.M.C. 2627/2026 to respondent no.2 in three instalments. It is an admitted position that the petitioner no.1 has paid the entire amount of Rs. 9,00,000/- to respondent no.2. 3. Issue notice. 4. Notice is accepted by the APP appearing on behalf of the State. 5. Respondent no.2 appears through video-conferencing and has been identified by her counsel as well as by the Investigating Officer (IO). She informs the Court that she has settled the matter of her own free will and without any coercion. She further states that she has no objection to quashing of the FIR. She also submits that she has received the entire sum of Rs. 9,00,000/- from the petitioners. 6. The petitioners appear through video conferencing and have been identified by their counsel. They affirm the statement of the respondent no.2 and undertake to abide by the terms of settlement arrived at between the parties. 7.
Considering the above settlement between the parties, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Hence, it would be in the interest of justice to quash the aforementioned FIR and the proceedings pursuant thereto. 8. Consequently, the FIR No. 316/2016 registered at Police Station Sunlight Colony, Delhi and the proceedings pursuant thereto are quashed. 9. The petition stands disposed of. 10.
