Yes. 2 2026:HHC:35244 3. For the sake of convenience, the parties to the present  lis,  are,   hereinafter   referred   to,   in   the   same manner, as were, referred to, by the learned trial Court. 4. Plaintiff   Chhotu   Ram   has   filed   a   suit   for permanent prohibitory injunction, against the defendants, on   the   basis   of   the   agreement,   by   virtue   of   which   the subject matter of the lis was rented out to the defendants. As per the averments in the plaint, the rent agreement, which, was initially executed in the year 2018, has been extended   on   various   dates   and   the   rent   of   the   subject matter of the lis, was increased from Rs. 12,000/ to Rs. 20,000/. 5. Along with the suit, application under Order 39 Rules 1 and 2 C.P.C. has been filed, in which, the learned trial Court has passed the following order: “Both the parties are directed to maintain status quo qua possession   of   the   suit   land   and   respondents   are restrained from forcibly evicting the applicant from  the suit land, except in accordance with law.” 6. As   per   the   averments   of   the   application, despite   passing   of   the   order   dated   05.12.2025,   the defendants   have   blocked   the   egress   of   the   suit   land. Resultantly, the plaintiff could not enjoy the usufruct of the suit land. 7. It is his further case that the defendants, with the help of their servants, relations, representatives etc. put ‘Dharna’ on the alleged path, so the vehicle, which, has been parked on the suit land, could not be taken out from there. 8. The said application has been contested by the defendants. 9. Thereafter, the learned trial Court has called for the status  report, from the concerned SHO and on the basis of the said report, the application under Section 151 CPC has been allowed, vide order dated 30.12.2025, by providing the police help to the plaintiff. The operative portion of the order dated 30.12.2025, read as under: “Let   the   concerned,   Police   Thana   be   directed   that implementation of the order dated 05.12.2025 be ensured on the spot, and barbed wire fencing be removed only to   extent   it   is   blocking   the   ingress/outgress   of vehicles   etc. from   the   suit   land,   even   by   use   of necessary force required under the circumstances at the 4 2026:HHC:35244 spot. Copy of this order be also sent along with the order. The application stands disposed of.” 10. In   such   situation,   when,   the   order   dated 30.12.2025,   has   already   been   executed,   the   present petition is disposed of by requesting the learned trial Court to decide the application under Order 39   Rules 1 and 2 CPC,   after   completion   of   the   pleadings,   expeditiously, preferably within a period of one month from the date of appearance of the parties, before the learned trial Court, being uninfluenced by the order dated 30.12.2025. 11. Parties,   through   their   respective   counsel,   are directed   to   appear   before   the   learned   trial   Court   on 03.09.2026, at 10:00 am. 12.
