[2026:RJ-JP:1645] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 14114/2025 Nandkishor @ Nandlal S/o Nathulal, Aged About 50 Years, R/o Karel, Police Station Malarna Dungar, District Sawai Madhopur, Rajasthan. (At Present He Is Confined In District Jail, Dausa). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Laxman Meena For Respondent(s) : Mr. Vivek Sharma, PP Mr. Kritin Sharma HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 15/01/2026 1. The petitioner has filed this bail application under Section 483 of BNSS in FIR No.80/2023 registered at Police Station Jhapada, District Dausa for offences under Sections 302 and 452 of IPC, 1860. 2. Heard learned counsel for the petitioner, learned Public Prosecutor as well as learned counsel for the complainant and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that neither the FIR nor the statement recorded before the trial Court reflects any motive attributable to the petitioner for committing the alleged offence. Moreover, the recovery of the axe from an open place casts serious doubt on the prosecution’s story. Petitioner is behind the bars since 28.07.2025. The trial of the [2026:RJ-JP:1645] (2 of 2) [CRLMB-14114/2025] case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, hence, the bail application of the petitioner may be allowed. 4. Per contra, learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail application, stating that there is specific financial transaction which is reflected as motive behind the alleged offence. 5. On consideration of the rival submissions and material available on record and in the light of submissions made by learned Public Prosecutor as well as looking to the gravity of offence and specific act attributed to the petitioner but without expressing any opinion on merits/demerits of the case, I am not inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is hereby dismissed. (PRAMIL KUMAR MATHUR),J Chandan/44
